DMCA and Copyright Policy

PitStop, Inc. ("PitStop") respects the intellectual property rights of others and expects users of our Platform to do the same. This policy explains how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA").
1.Reporting Copyright Infringement
1.1 DMCA Takedown Notice
If you believe content on PitStop infringes your copyright, please send a written notice to our Designated Copyright Agent containing:
- •(a) Your physical or electronic signature;
- •(b) Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list);
- •(c) Identification of the material you claim is infringing and information reasonably sufficient to locate it (e.g., URL);
- •(d) Your contact information (address, phone number, email);
- •(e) A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
- •(f) A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

2.Counter-notification
2.1 If Your Content Was Removed
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification containing:
- •(a) Your physical or electronic signature;
- •(b) Identification of the material that was removed and its location before removal;
- •(c) A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification;
- •(d) Your name, address, and phone number;
- •(e) A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which PitStop may be found), and that you will accept service of process from the person who provided the original DMCA notification.
2.2 Counter-notification Process
Upon receiving a valid counter-notification:
- •We will forward it to the original complainant
- •If the complainant does not file a lawsuit within 10-14 business days, we may restore the content
3.Repeat Infringer Policy
3.1 Termination for Repeat Infringement
PitStop will terminate accounts of users who are repeat infringers in appropriate circumstances.
3.2 Strike System
- •First strike: Warning and content removal
- •Second strike: Temporary account suspension
- •Third strike: Permanent account termination
We reserve the right to terminate accounts with fewer strikes for serious or willful infringement.
4.Misrepresentation Warning
Under Section 512(f) of the DMCA, anyone who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.
Before filing a DMCA notice, please carefully consider whether the use may be permitted under fair use or other legal doctrines.

5.2 Counterfeit Products
To report counterfeit parts being sold on PitStop:
